We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. Recent financial events, especially the subprime and the sovereign debts crises, have revived debate on debts, the necessity of debt repayment and the eventuality of debt cancellations. A milestone in this debate was reached by David Graeber’s Debt (Brooklyn: Melville House, 2011), but despite the richness of this essay, many normative questions remain unanswered. Should debt always be repaid? Who should repay it? Should government deficits be allowed or even encouraged? Alexander Douglas’ recent book aims to provide an answer (...) to all these questions. The main endeavour of the book lies in applied philosophy, that is in finding general principles able to answer such questions and to reconcile our possibly conflicting intuitions about debt and credit. This volume, modeled after those published in The Library of Living Philosophers, attempts to provide a coherent statement of the work of Abraham Edel in moral and political theory, and on the impact of his work on such diverse areas as education, law, and social science. The methodological element of Edel's work is to see ethical and social theory in the full context of human life; specifically how twentieth-century modes of analysis impact classical concerns about right and wrong, good and (...) evil. The volume is tightly integrated from start to finish, and has the benefit of Edel's thoughtful and thoroughgoing response to critics. In several jurisdictions, sex offenders may be offered chemical castration as an alternative to further incarceration. In some, agreement to chemical castration may be made a formal condition of parole or release. In others, refusal to undergo chemical castration can increase the likelihood of further incarceration though no formal link is made between the two. Offering chemical castration as an alternative to further incarceration is often said to be partially coercive, thus rendering the offender’s consent invalid. The dominant response to (...) this objection has been to argue that any coercion present in such cases is compatible with valid consent. In this article, we take a different tack, arguing that, even if consent would not be valid, offering chemical castration will often be supported by the very considerations that underpin concerns about consent: considerations of autonomy. This is because offering chemical castration will often increase the offender’s autonomy, both at the time the offer is made and in the future. (shrink)

Can philosophy be a source of hope? Today it is common to believe that the answer is no - that providing hope, if it is possible at all, belongs either to the predictive sciences or to religion. In this exciting and simulating book, however, Alexander Douglas argues that the philosophy of Spinoza can offer something akin to religious hope. Douglas shows how Spinoza is able, without appealing to belief in any traditional afterlife or supernatural grace, to develop a (...) profound and original theory of how humans can escape from the conditions of death and sin. Douglas argues that this theory of escape, which Spinoza calls beatitude, is the centrepiece of his entire philosophy, though scholars have often downplayed or ignored it. One reason for this scholarly neglect might be the difficulty of understanding Spinoza's theory, which departs from the standard doctrines and methods of Western philosophy. Douglas's interpretation therefore seeks inspiration beyond the Western tradition, drawing especially on the classical Daoist text Zhuangzi and its commentaries. Here, Douglas argues, surprising resonances with Spinoza's core ideas can be found, leading to a new way of understanding his strange yet compelling theory of beatitude. (shrink)

This paper presents a formalization of informal logic using the Carneades Argumentation System, a formal, computational model of argument that consists of a formal model of argument graphs and audiences. Conflicts between pro and con arguments are resolved using proof standards, such as preponderance of the evidence. CAS also formalizes argumentation schemes. Schemes can be used to check whether a given argument instantiates the types of argument deemed normatively appropriate for the type of dialogue.

The Nature and Status of Critical Questions in Argumentation Schemes.

The partial ordering of Medvedev reducibility restricted to the family of Π0 1 classes is shown to be dense. For two disjoint computably enumerable sets, the class of separating sets is an important example of a Π0 1 class, which we call a ``c.e. separating class''. We show that there are no non-trivial meets for c.e. separating classes, but that the density theorem holds in the sublattice generated by the c.e. separating classes.

This paper shows how the critical questions matching an argumentation scheme can be mod-eled in the Carneades argumentation system as three kinds of premises. Ordinary premises hold only if they are supported by sufficient arguments. Assumptions hold, by default, until they have been questioned. With exceptions the negation holds, by default, until the exception has been supported by sufficient arguments. By “sufficient arguments”, we mean arguments sufficient to satisfy the applicable proof standard.

This paper compares the features and methods of the two leading implemented systems that offer a tool for helping a user to find or invent arguments to support or attack a designated conclusion, the Carneades Argumentation System and the IBM Watson Debater tool. The central aim is to contribute to the understanding of scholars in informal logic, rhetoric and argumentation on how these two software systems can be useful for them. One contribution of the paper is to explain to these (...) potential users how the two tools are applicable to the task of inventing arguments by using some simple illustrative examples. This article considers what can be learned regarding the ethical acceptability of intrusive interventions intended to halt the spread of infectious disease (‘Infection Control’ measures) from existing ethical discussion of intrusive interventions used to prevent criminal conduct (‘Crime Control’ measures). The main body of the article identifies and briefly describes six objections that have been advanced against Crime Control, and considers how these might apply to Infection Control. The final section then draws out some more general lessons from the foregoing (...) analysis for the ethical acceptability of different kinds of Infection Control. (shrink)
